GENERAL TERMS AND CONDITIONS
Thank you for your interest in our products! Below you will find the terms and conditions that apply to your purchase and explain your rights. If you have any questions, please feel free to contact us and we will be happy to explain how everything works.
GENERAL
These General Terms and Conditions (the “General Terms and Conditions”) apply when you (the “Customer” or “you”) place an order with Colting Endurance AB (the “Company”, “us”, “we” or “our”) through coltingwetsuits.com (the “Website”).
By accepting these General Terms and Conditions, you confirm that you are at least 18 years old, or that you have the permission of your legal guardian, and that you agree to comply with these General Terms and Conditions.
You also confirm that you have read the information regarding our processing of personal data and use of cookies and consent to the use of such data in accordance with our Privacy Policy.
We sell our products in several countries and jurisdictions, and these General Terms and Conditions are intended to apply globally. However, depending on where you live, mandatory local laws may apply. We respect all applicable laws, and nothing in these General Terms and Conditions shall be interpreted as limiting your statutory rights where applicable law provides you with greater rights than those set out herein.
By accepting these General Terms and Conditions, you understand and agree that all orders, purchases and transactions are entered into exclusively between the Company and the Customer.
ORDERS
When you receive an order confirmation from us, this means that your order has been accepted and a purchase agreement has been entered into between you and the Company. We recommend that you save the order confirmation for any future communication with us.
We may reject an order for various reasons, for example if you have provided incorrect personal information and/or have outstanding debts. You may cancel your order until we have confirmed it. In such case, we will refund any payments charged to you or your debit or credit card in connection with the order.
We may cancel an order if the products ordered are out of stock. In such case, we will refund any payments made and, where possible, inform you of equivalent products that are available.
All products ordered remain our property until we have received full payment for them.
CUSTOMER INFORMATION
You are responsible for ensuring that the personal information you provide to us is accurate and complete. You are responsible for all purchases made using your login credentials.
You must keep your login credentials confidential and ensure that no other person gains access to them without your permission. Please notify us immediately if you suspect that someone has obtained access to your login credentials without your authorization.
PRICES AND FEES
The prices stated on the Website apply to orders placed through the Website. All prices are stated in the currency displayed on the Website and include VAT where indicated. Depending on where you live, VAT may not apply to your purchase.
Unless otherwise stated on the Website, payment and shipping costs are not included and will be displayed separately.
Please note that local charges, such as currency conversion fees, debit or credit card fees, VAT, customs duties and other taxes or charges, may apply depending on where you live and the applicable local laws. You are responsible for such charges, and they will not be reimbursed by us.
SPECIAL OFFERS
From time to time, we may offer more favorable terms for certain products than those stated in these General Terms and Conditions, for example extended cancellation or return periods or free returns.
Such special terms apply only for a limited period of time or until the relevant products are sold out. We may withdraw such offers at any time, after which these General Terms and Conditions will apply without modification.
SHIPPING AND DELIVERY
Products that are in stock are normally delivered within the number of business days stated on the Website. The estimated delivery time for your order will be stated in the order confirmation.
In the event of a delay, we will inform you and continue to monitor your order.
You may cancel your order if delivery is delayed by more than 30 days, provided that the delay was not caused by you.
Depending on the shipping method, you may be required to collect your order from a designated collection point. You must collect the order within the period specified in the delivery notification.
If you fail to collect your order within the specified period, you may be charged a fee and the order may be returned to us at your expense. We may also cancel the order if it is not collected in time.
RIGHT OF WITHDRAWAL
You have the right to withdraw from your purchase by notifying us within 14 days of receiving your products.
To be eligible for a refund, the product must not have been used. You must send us a notice of withdrawal containing your name, address, email address, order number and a list of the products concerned, for example by using the form available on the Website.
You must then return the products to us at your own expense without undue delay and no later than 14 days after sending your notice of withdrawal.
You are responsible for the condition of the products during their return to us. We therefore recommend that you package them securely and return them in good condition and, where possible, in their original box and/or packaging.
We will issue your refund as soon as possible and no later than 14 days after receiving your notice of withdrawal. However, we may withhold the refund until we have received the returned products or until you have provided proof that the products have been sent back to us, such as a shipping receipt.
Unless otherwise agreed, the refund will be made using the same payment method that you used for the original purchase.
Your right of withdrawal does not apply to products that have been used.
WARRANTY AND COMPLAINTS
Some of our products may be covered by warranties. Information regarding such warranties will be provided on the Website or in these General Terms and Conditions. Your order confirmation serves as proof of warranty.
Our warranties cover manufacturing defects only and do not cover defects resulting from individual modifications to the function or appearance of the products following alteration, upgrading or other modification.
Within two years of receiving the products, or such longer period as may be required by applicable law, you may submit a complaint regarding products that are defective under applicable consumer protection legislation.
To submit a complaint, you must provide us with your name, address, email address, order number and a list of the products concerned, for example by using the form available on the Website.
You must submit your complaint as soon as possible after discovering the defect. Any complaint submitted within two months of discovering the defect will be considered to have been submitted within a reasonable period of time.
We will provide remedies or refunds for defective products in accordance with applicable consumer protection legislation and will cover the reasonable costs associated with returning defective products to us.
Our aim is to issue any applicable refund within 30 days after receiving the complaint and determining that a refund is due, although this may take longer depending on the nature of the product.
We also aim to comply with guidelines concerning defective products issued by relevant national consumer protection authorities.
Unless otherwise agreed, any refund will be made using the same payment method that you used to purchase the defective products.
LIMITATION OF LIABILITY
Unless otherwise required by applicable local law, our liability is limited to direct damages, and under no circumstances shall we be liable for indirect or consequential damages, such as loss of income or similar losses.
INTELLECTUAL PROPERTY RIGHTS
The Website and all of its content are owned by us and/or our licensors and are protected by applicable intellectual property and marketing laws.
This means that trademarks, company names, product names, images, graphics, designs, layouts and information relating to products, services and other content may not be copied or used without our prior written consent.
DISCLAIMER
We reserve the right to correct errors in images, typography and information on the Website, including errors in product descriptions, technical specifications, prices and information regarding product availability.
We have the right to correct obvious errors and may change or update information on the Website at any time.
Images displayed on the Website are for illustrative purposes only and do not constitute a guarantee regarding the exact quantity, appearance, functionality or origin of the products you receive when placing an order.
CHANGES TO THESE GENERAL TERMS AND CONDITIONS
We may amend these General Terms and Conditions at any time. Any amended General Terms and Conditions will be published on the Website and will take effect when you accept them, for example when placing a new order through the Website or otherwise accepting the updated terms.
GOVERNING LAW AND DISPUTE RESOLUTION
In the event of a dispute, we aim to comply with decisions issued by the relevant national consumer protection authorities.
Any disputes concerning the interpretation or application of these General Terms and Conditions shall be governed by and construed in accordance with the laws applicable in the country or state from which we conduct our business and shall be subject to the non-exclusive jurisdiction of the courts where we have our registered office.
“Non-exclusive jurisdiction” means that you may bring proceedings against us in another jurisdiction where you have the right to do so under applicable national law.
